Welcome to Nyumba Kiganjani ("we", "our", "us"). These Terms of Service ("Terms") govern your use of our mobile application and public website. By downloading, accessing, or using Nyumba Kiganjani, you agree to these Terms.
1. Our Service
Nyumba Kiganjani is a property marketplace for Tanzania. Tenants can search, save, and inquire about rental properties, and communicate directly with landlords. Landlords can create accounts, list properties, and respond to inquiries. The service is free for tenants; landlords may require a paid subscription to publish and manage listings.
2. Eligibility & Accounts
- You must be at least 18 years old, or have a parent/guardian's permission, to create an account.
- You must provide accurate information (name, phone number, email) and keep it up to date.
- You are responsible for activity under your account. Do not share your verification codes or login credentials.
- We may suspend or terminate accounts that provide false information or violate these Terms.
3. Landlord Listings & Verification
- Landlords must only list properties they own or are legally authorized to rent out.
- Listings must be accurate: correct price, location, photos, availability, and description. Misleading listings are prohibited.
- Listings go live as soon as landlords publish them. A "Verified" badge means our team has confirmed property ownership — always still verify in person before paying.
- We may remove or hide listings that are reported as fraudulent, duplicate, expired, or in violation of these Terms.
4. Subscriptions & Payments
- Tenant features (search, chat, favorites) are 100% free.
- Landlord subscription plans (e.g. listing quotas) are billed through Google Play Billing and subject to Google Play's terms.
- Subscriptions auto-renew unless cancelled in Google Play before the renewal date. Refunds are handled under Google Play's refund policy.
- We do not process rent payments — all rent agreements and payments happen directly between tenants and landlords, at their own risk.
5. Acceptable Use — You Agree Not To
- Post false, misleading, or stolen property listings or photos.
- Impersonate another person, landlord, or Nyumba Kiganjani staff.
- Charge advance "viewing fees" or demand payment before a physical viewing.
- Send spam, harassment, hate speech, or unlawful content through messages.
- Scrape, copy, reverse-engineer, or misuse the app, website, or other users' data.
- Use the platform for any illegal purpose under the laws of Tanzania.
6. Safety & Scam Prevention
- Never pay before visiting a property. Meet the landlord at the property and ask for proof of ownership.
- Report suspicious listings, messages, or users via the app or email immediately.
- We provide verification badges and reporting tools, but we cannot guarantee every listing. You transact at your own risk.
7. Intellectual Property
The Nyumba Kiganjani name, logo, designs, and app content are owned by us and protected by law. You may not copy or reuse them without written permission. By uploading listing photos and descriptions, you grant us a license to display and distribute them within the service.
8. Termination
You may delete your account at any time from the app settings. We may suspend or terminate your access if you violate these Terms, engage in fraud, or misuse the platform. Sections relating to liability, ownership, and dispute resolution survive termination.
9. Disclaimers & Limitation of Liability
The service is provided "as is" without warranties. To the maximum extent permitted by law, Nyumba Kiganjani is not liable for: rental disputes between tenants and landlords; losses from reliance on listings or verification badges; or indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us (if any) in the 12 months before the claim.
10. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania. Disputes will first be addressed through good-faith negotiation and support, then through the competent courts of Tanzania.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated in-app or on this page with an updated date. Continued use after changes means you accept the updated Terms.
